Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites at www.pegs.org.in and www.myestatez.com, the My Estatez mobile application, the PEGS APIs, and other digital services provided by PEGS Standards & Systems Private Limited(“PEGS”, “we”, “us”, “our”) (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and by the Privacy Policy, User Consent Notice, Cookie Policy, Refund Policy, and other documents referenced here.

About PEGS

PEGS Standards & Systems Private Limited is a company incorporated under the laws of India, with its registered office at 10th Floor, Building 4, North Wing, NESCO IT Park, Western Express Highway, Goregaon East, Mumbai – 400063, Maharashtra, Bharat (India).

Eligibility

You must be at least 18 years of age and competent to contract under applicable law to register for or use the Services. By using the Services you represent that you meet this requirement.

Where you use the Services on behalf of an entity, you represent that you are authorised to bind that entity to these Terms.

If PEGS becomes aware that a user is under 18 years of age, PEGS may suspend or restrict the account unless lawful parental or guardian consent is obtained where applicable. The Services are not intended for children unless a specific Service expressly states otherwise.

Your Account

You are responsible for maintaining the confidentiality of your credentials and for all activity carried out through your account. Notify PEGS promptly of any unauthorised access or suspected security incident.

PEGS may verify your identity, organisation, or other details, including by requesting documents or by using third-party verification providers. Inaccurate or incomplete information may lead to suspension or termination of access.

Use of the Services

You may use the Services only for lawful purposes, in compliance with these Terms and applicable law. You will not:

  • interfere with, disrupt, probe, scan, or test the vulnerability of the Services;
  • attempt to gain unauthorised access to any account, system, or data;
  • use the Services to transmit unlawful, fraudulent, infringing, defamatory, or harmful content;
  • copy, reverse-engineer, or create derivative works of the Services except as permitted by law; or
  • use automated systems (bots, scrapers, crawlers) in a manner that imposes an undue load on the Services.

4.1 Fair Digital Interface Commitment

PEGS will not knowingly use deceptive interface practices that mislead users into taking actions they did not intend, including false urgency, forced action, subscription traps, interface interference, bait and switch, drip pricing, disguised advertisements, nagging, trick questions, SaaS billing manipulation, or other dark patterns prohibited under applicable consumer-protection guidance.

Communications

By using the Services, you agree to receive transactional and security-related communications necessary for the Services, including OTPs, account alerts, invoices, receipts, policy notices, service confirmations, and security notices.

PEGS does not send marketing or promotional communications unless you have explicitly opted in.

You may opt out of optional communications through account settings, unsubscribe links, preference tools, telecom consent/revocation mechanisms where applicable, or by contacting PEGS. Opting out of optional communications will not stop transactional or security communications required to provide or secure the Services.

Fees, Payments and Refunds

PEGS will disclose applicable fees, taxes, billing cycle, renewal terms, cancellation conditions, and refund eligibility before payment wherever applicable.

Any purchase, paid subscription, renewal, or paid service activation will require explicit and affirmative user action. PEGS will not treat silence, inactivity, pre-ticked boxes, or hidden defaults as consent for purchase.

Where auto-renewal or recurring billing applies, PEGS will disclose the billing frequency, amount or pricing basis, cancellation method, and payment provider before activation.

Refunds are governed by the PEGS Refund Policy.

6.1 Subscription Cancellation

Where PEGS offers subscription-based Services, you may cancel future renewals through the method disclosed at subscription or through PEGS support.

Cancellation will prevent future billing unless otherwise disclosed before purchase. Refunds for current or past billing periods are governed by the Refund Policy.

PEGS will not make cancellation impossible, hidden, unnecessarily complex, or dependent on unrelated actions. Cancellation instructions will be reasonably clear and accessible.

Service-Specific Terms

Specific Services — including ESG Indication, ESG Assessment, ESG Certification, UAIN issuance and lifetime asset records, PEGS Club memberships, the Partner Programme, and the My Estatez app — may be subject to additional service-specific terms, scoping documents, statements of work, or partner agreements provided to you in connection with that Service. In the event of a conflict between these Terms and a Service-specific document signed by both parties, the Service-specific document controls for that Service.

Tier Independence

Where the Services use Colour, Metal, and Gem tiers across multiple layers — including ESG certifications, PEGS Club memberships, Partner Network tiers, and lender or banking partner tiers — each layer is graded independently. A tier in one layer does not automatically confer or guarantee a tier in any other layer. Specific economic effects across layers are disclosed in the relevant Service documentation.

Intellectual Property

The Services, including the PEGS name, the PEGS ESG framework, the BASTION network architecture, the S.O.P.H.I.E. methodology, the My Estatez application, documentation, designs, logos, trademarks, and software, are owned by PEGS or its licensors and are protected under Indian and international intellectual property laws.

PEGS grants you a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for their intended purpose, subject to these Terms and to any applicable Service-specific terms. No other rights are granted.

Content you submit to the Services remains yours. You grant PEGS a non-exclusive, royalty-free licence to use, store, process, and display such content as needed to provide, secure, and improve the Services.

Third-Party Services

The Services may include links to or integrations with third-party websites, applications, or services. PEGS is not responsible for the content, policies, or practices of those third parties. Your use of a third-party service is subject to that third party's terms and privacy policy.

Suspension and Termination

PEGS may suspend, restrict, or terminate access to the Services, or any part of them, where:

  • you breach these Terms or applicable law;
  • continued access creates a risk of harm to other users, PEGS, or third parties;
  • continued access is incompatible with legal, regulatory, cybersecurity, payment, sanctions, fraud-prevention, or law-enforcement requirements; or
  • the relevant Service is discontinued.

Where reasonable, PEGS will give prior notice and an opportunity to remedy the breach. PEGS may suspend immediately without notice in cases of suspected fraud, security incidents, or material risk.

You may stop using the Services at any time. Termination does not affect rights and obligations that have already accrued.

Privacy and Data Protection

Your use of the Services is subject to the PEGS Privacy Policy and User Consent Notice, which explain how PEGS collects, uses, shares, stores, secures, and deletes personal data.

You may exercise data rights, withdraw consent, raise privacy grievances, or contact PEGS using the methods described in the Privacy Policy.

Where the DPDP Act, 2023 and DPDP Rules, 2025 apply, PEGS will provide a clear contact point for data-related queries and will respond to grievances within the period required by applicable law.

Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law:

  • the Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied;
  • PEGS does not warrant that the Services will be uninterrupted, error-free, or completely secure;
  • ESG indications, assessments, certifications, and scoring outputs are provided for informational and decision-support purposes and are based on the data supplied to PEGS; they do not constitute investment, legal, tax, accounting, or financial advice; and
  • PEGS is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, goodwill, or data.

Where liability cannot be excluded under applicable law, PEGS's aggregate liability for any claim arising out of or relating to the Services is limited to the amount paid by you to PEGS for the relevant Service in the twelve months preceding the event giving rise to the claim.

Nothing in these Terms limits any mandatory consumer rights available under applicable law.

PEGS will endeavour to acknowledge consumer complaints within forty-eight hours and resolve them within one month from receipt, where the Consumer Protection (E-Commerce) Rules, 2020 apply.

Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to the consumer-grievance and statutory rights available under applicable law, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Services.

Changes to These Terms

PEGS may update these Terms from time to time. Material changes will be notified through the Services, by email, or by other reasonable means. The version, last-updated date, and effective date appear at the top of these Terms. Continued use of the Services after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by applicable law.
